Medical Records Software Compliance Checklist: ABDM, DPDP, HIPAA, GDPR

Medical Records Software Compliance Checklist: ABDM, DPDP, HIPAA, GDPR

This guide gives a practical checklist for choosing medical records software. It is general information, not legal advice. Your clinic's obligations depend on where you practise, the services you provide and the data you hold. Confirm the details with a qualified adviser.

Start with three questions

Where are your patients, and where is their data stored?
Who is the data controller, and who processes the data for you?
Which national or regional rules apply to the services you offer?

India: ABDM and the DPDP Act, 2023

The Ayushman Bharat Digital Mission (ABDM) uses consent-based exchange of health records, linked to a patient's ABHA. The Digital Personal Data Protection Act, 2023 sets duties for collecting, using, storing and deleting personal data, including consent and purpose limits.

Ask your vendor to show how consent is captured and recorded, how a patient can see or withdraw consent, how long data is kept, and how deletion requests are handled.

United States: HIPAA

HIPAA covers protected health information held by covered entities and their business associates. If a software vendor handles that information for you, you normally need a business associate agreement (BAA). Ask for the BAA, a summary of safeguards and the vendor's incident response process.

European Union: GDPR

GDPR requires a lawful basis for processing, data-subject rights such as access and erasure, and a data processing agreement with each processor. Ask where data is stored and whether any transfers outside the EU are covered by appropriate safeguards.

Security controls to check in any product

Role-based access so each user sees only what they need
Audit logs that record who viewed or changed a record and when
Encryption in transit and at rest
Tested backups, with a documented restore process
Multi-factor authentication for staff accounts
A written process for breach notification

A checklist to take to vendor calls

Can you show the consent workflow for ABDM?
Where is our data hosted, and what is the backup location?
Will you sign a data processing agreement or a BAA if we need one?
How do we export or delete all of our data?
What is your breach notification timeline?
Which certifications or audits can you share?

How MedeilPlus approaches this

MedeilPlus Cloud is built for healthcare data. ABDM integration is live in India. The platform runs on Microsoft Azure, with Central India as the primary region for data residency. Ask for current documentation on access controls, audit logs and data handling before you decide, because your obligations and our documentation should be checked together.

Frequently asked questions

Is cloud medical records software compliant?

Cloud software can meet these rules when the vendor provides the right controls, agreements and documentation. Compliance depends on how the software is configured and used, so confirm both.

What is the difference between ABDM and DPDP?

ABDM is the national framework for exchanging health records through ABHA. The DPDP Act is the law that governs personal data, including health data, across most uses.

Do I need a BAA for HIPAA?

If a vendor creates, receives, maintains or transmits protected health information for you, a BAA is normally required. Confirm the exact requirement with your compliance adviser.
